The marriage contract (marriage contract) can be concluded by a woman and a man who has applied for registration of their marriage, as well as by their spouse. Minors who wish to conclude a marriage contract before the marriage is registered must be certified as notarized with the signed consent of their parents or guardians. Canon Law: Letter and Spirit, a commentary on canon law, states that this condition can be defined as “a provision that conditioned an agreement on the verification or fulfillment of a circumstance or event that is not yet certain.” It is also stated that “any condition related to the future of conjugal consent invalidates marriage”. For example, a marriage would not be valid if the parties have decided that they should have children or that they would have the right to divorce and remarry someone else. [Citation required] A couple might want their agreement to be verified by a lawyer. If so, remember that any partner is required to seek legal advice from their own lawyer (i.e. independent legal advice) in order to avoid problems such as coercion or fraud. But Frawley says, “Marriage contracts can be difficult because you talk about the unknown and it`s negotiated during a period of happy marriage planning.” The marriage contract in Thailand is signed on the basis of the mutual agreement of the man and woman who want to get married. Under Thai law, a marriage contract is recognized by the Commercial and Civil Law Code of Thailand. A valid and enforceable Thai marriage contract is mandatory if: for example, the California Family Code, Section 1612(c), provides that the waiver of spousal pension absolutely requires that the party waiving the law be represented by an independent attorney at the time of entering into the contract.
Therefore, if a lawyer has not advised the party and signed the marriage contract (the completed independent legal advice certificate), the waiver is not applicable. While there are many advantages of marriage contracts for conventional marriages, the benefits are usually multiplied when the parties come from different countries, have assets abroad or live abroad. SWEDEN Initial contracts can be implemented in Sweden. Independent legal advice focuses on the fact that each party has a different lawyer to explain the terms of the agreement and advise them on what is in their best interest. While it is not normally necessary for parties to a marriage contract to have independent lawyers, this can serve as additional coverage. . . .
